§ 160-25. Procedure for minor subdivision final plans.

The procedure for minor subdivision final plans is as follows:A.Applicant prepares minor subdivision plan and application.B.Applicant submits 12 copies of the minor subdivision plan and application.C.Township Manager checks for completeness, and if:(1)Submission is incomplete, immediately returns submission to the applicant and indicates the deficiencies.(2)Submission is complete, accepts minor subdivision plan, application and fee.D.Township Manager shall distribute copies of the plan and application to:[Amended 2-21-2006 by Ord. No. 375](1)Township Planning Commission: seven copies.(2)Bucks County Planning Commission: one copy.(3)Township files: one copy.(4)Township Engineer: one copy.(5)(Reserved)Editor’s Note: Former Subsection D(5), regarding the copies required for the Shade Tree Commission, was repealed 10-4-2016 by Ord. No. 442.(6)Environmental Advisory Commission: one copy.E.Bucks County Planning Commission reviews the plan and prepares analysis for review by the Upper Southampton Township Planning Commission.F.At a regular meeting following receipt of the complete submission to the Township Manager, the Upper Southampton Township Planning Commission:(1)Receives and reviews the applicant's submission.(2)Receives and reviews report by the Bucks County Planning Commission and Township Engineer.(3)Listens to the applicant's presentation and discusses submission with the applicant.(4)Evaluates the applicant's submission, presentation, discussion with the applicant, and the County Planning Commission's report and the Township Engineer's report.(5)Determines whether the final plan meets the objectives and the requirements of this chapter and other applicable ordinances.(6)Recommends approval or disapproval, or approval with revisions and comments, to the Board of Supervisors in a report and sends a copy to the applicant.G.The Board of Supervisors shall render its decision and communicate it to the applicant not later than 90 days following the date of the regular meeting of the Township Planning Commission next following the date of the application, provided that if the said next regular meeting shall occur more than 30 days following the filing of the application, the said ninety-day period shall be measured from the 30th day following the day the application has been filed. The decision of the Board shall be in writing and shall be communicated to the applicant personally, or mailed to him at his last known address, not later than 15 days following the decision. If changes in the preliminary plan are required, the decision shall set forth the applicable provisions of the ordinances which must be satisfied in order to obtain approval.H.If approved:(1)The Board of Supervisors shall adopt a resolution approving the final plan.(2)Three exact copies of the approved final plan on Mylar and three paper copies with the signatures of the required agencies as specified in § 160-88 shall be submitted to the Township Manager.[Amended 2-21-2006 by Ord.
